Expanded Medical Marijuana Access Signed into Law in New Hampshire

5 August 2024

New Hampshire has implemented substantial reforms to its medical cannabis program, as the governor signed into law two bills designed to expand access and eligibility. Under HB 1278, healthcare providers can now recommend medical cannabis for any debilitating or terminal condition if they determine the potential benefits outweigh the risks. SB 357 further broadens access by allowing all licensed prescribers of controlled substances to certify patients for medical marijuana. These updates signify a major shift from previous policies, which limited recommendations to a narrow list of qualifying conditions.

Advocates consider the new legislation a breakthrough, emphasizing its ability to support patients with a wider range of medical conditions, including chronic pain, anxiety disorders, and long COVID symptoms. With over 13,000 participants already enrolled in the state's medical cannabis program, the laws are anticipated to significantly boost enrollment, expand treatment options, and improve access for underserved residents.

These changes are also expected to invigorate New Hampshire’s medical cannabis market. Dispensaries may experience increased demand and revenue growth, while patients benefit from safe and legal access to therapeutic cannabis products. By aligning with states like California and Maine, which provide physicians with greater discretion to recommend cannabis, New Hampshire is positioning itself as part of a broader national trend.
